Man seeks coverage of son's medical treatment

SAN FRANCISCO – A father is suing his insurance company over the alleged denial of benefits for his son's medical treatments.

Rodney K. and Brian K. filed a complaint on March 22 in the U.S. District Court for the Northern District of California against Aetna Life Insurance C., citing violation of the Employee Income Retirement Act.

According to the complaint, Brian K. was diagnosed with multiple conditions and required residential treatment at a center in Utah. The plaintiffs holds Aetna Life Insurance Co. responsible because the defendant allegedly denied benefit coverage for the treatment multiple times on the basis that Brian K. no longer meet the criteria for residential treatment despite of the medical records presented. The suit states the total unpaid charges are $174,160.

The plaintiffs seek the following: unpaid expenses, all legal fees and any other relief as the court deems just and proper. They are represented by David M. Lilienstein of DL Law Group in San Francisco and Brian S. King of Brian S. King PC in Salt Lake City, Utah.
