OAKLAND – A Newark business has filed a suit against an Oakland labor organization over allegations of unlawful conduct regarding a master agreement.
Installit Inc. filed a complaint on March 28 in the U.S. District Court for the Northern District of California, Oakland Division against Carpenters 46 Northern California Counties Conference Board, a labor organization, citing violation of the Labor-Management Relations Act and the National Labor Relations Act.
According to the complaint, the plaintiff alleges that it was terminated as a signatory to a master agreement dated July 1, 2014, by the defendant. The suit states that because of the termination, the plaintiff lost all of its contracts with manufacturers and as a result, had to terminate its employees because its contracts require it to maintain its status as a union employer. The plaintiff holds Carpenters 46 Northern California Counties Conference Board responsible because the defendant purportedly would not accept the plaintiff as a signatory unless B-K Mill & Fixtures Inc. agreed that it would be a signatory to the master agreement, which the plaintiff alleges is unlawful activity.
The plaintiff seeks the following: compensation for trial by jury, all damages, all legal fees and any other relief as this court deems just. It is represented by Fenn C. Horton III of Pahl & McCay in San Jose.
