SAN FRANCISCO – Two men are suing their former employer over allegations they were forced to work during breaks and were not paid overtime.
Rodolfo Solorzano and Jose Velez filed a class-action lawsuit on March 28 in the U.S. District Court for the Northern District of California against MGA Drivers, Antonio Aguilar, Marisela Aguilar, Avis Rent a Car System LLC and The Hertz Corp., citing violation of the Fair Labor Standards Act and California labor codes.
According to the complaint, the plaintiff alleges that they worked for more than 40 hours per work week but did not receive any overtime pay during their employment. The plaintiffs also allege that they were paid less than minimum wage and were forced to work during their break times. The plaintiffs hold MGA Drivers, Antonio Aguilar, Marisela Aguilar, Avis Rent a Car System LLC and The Hertz Corp. responsible because the defendants allegedly forced their employees to work during their meal breaks as well as knowingly paid them below minimum wage without paying overtime wages for extra hours their employees worked.
The plaintiffs seek the following: compensation for trial by jury, all damages, unpaid wages and overtime wages, liquidated damages, interest, all legal fees and any other relief as this court deems just and proper. They are represented by Robert David Baker of Robert David Baker Inc. in San Jose.
