SAN FRANCISCO – A Santa Clara County woman alleges her former employer did not pay proper wages and has filed a class-action suit.
Chrystiane Layog filed a complaint on behalf of all others similarly situated on April 15 in the U.S. District Court for the Northern District of California against Wells Fargo and Does 1 through 100 citing violation of the Fair Labor Standards Act and various labor codes.
According to the complaint, the plaintiff alleges that between December 2011 and July 2014, she worked for more than 40 hours per work week but did not receive any overtime pay for those extra hours worked. The plaintiff holds Wells Fargo and Does 1 through 100 responsible because the defendants had knowledge of plaintiff's working hours but chose not to pay overtime wages. She also alleges she was required to work during meal and rest breaks.
The plaintiff requests a trial by jury and seeks compensatory damages plus interest, payment of the correct wage rate for each hour plaintiff was not paid correctly, compensatory damages and statutory damages according to proof, treble damages, all legal fees and any other relief as this court deems just.
