Couple files malpractice suit over care received at VA Palo Alto Medical Center

SAN FRANCISCO – A couple alleges that the husband was injured while a patient at the VA Palo Alto Medical Center and has filed a suit.

Joseph Garcia and Marian Garcia filed a complaint on May 2 in the U.S. District Court for the Northern District of California citing medical and professional negligence.

According to the complaint, the defendant, though the Department of Veterans Affairs, manages the VA Palto Alto Health Care System and the VA Palo Alto Medical Center. The plaintiffs allege that on Aug. 6, 2014, Joseph Garcia was a patient at the medical center and claims personnel breached their duty to provide competent medical care. The plaintiffs hold United States of America and Does 1 through 10 responsible because the defendants allegedly caused injuries to Joseph Garcia as a result of their negligence and malpractice.

The plaintiffs seek general damages of more than $250,000, special damages, medical expenses, lost earnings and all incidental damages, all legal fees and any other relief as the court deems just. They are represented by Ramon E. Lewis of Law Offices of Ramon E. Lewis in San Diego.
