Western Addition Drywall accused of violating bargaining agreement

SAN FRANCISCO – Multiple trust funds are suing an employer alleging that it failed to pay monthly contributions to them.

District Council 16 Northern California Health and Welfare Trust Fund and its joint board of trustees; Bay Area Painters and Tapers Pension Trust Fund and its joint board of trustees; District Council 16 Northern California Journeyman and Apprentice Training Trust Fund and its joint board of trustees; et al. filed a complaint on May 4 in the U.S. District Court for the Northern District of California against Western Addition Drywall Inc. and James Bealum citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that from June 2015 to January they suffered damages as a result of unpaid contributions. The plaintiffs hold Western Addition Drywall Inc. and Bealum responsible because the defendants allegedly failed and refused to pay contributions on behalf of their employees per their bargaining agreement as well as refused to audit their payroll records.

The plaintiffs seek any unpaid contributions, liquidated damages on all late and unpaid contributions plus interest, all legal fees and any other relief as this court deems just. They are represented by Michele R. Stafford and Erica J. Russell of Saltzman & Johnson Law Corp. in San Francisco.
