SAN FRANSISCO – A website that notifies shoppers of digital offers has filed suit over allegations a Palo Alto company launched a similar website.
Retailmenot Inc. filed a complaint on April 25 in the U.S. District Court for the Northern District of California against Social Mail LLC and Ankesh Kumar alleging copyright infringement, trademark infringement, unfair competition, unjust enrichment and other counts.
According to the complaint, the plaintiff alleges that in 2015, Retailmenot Inc. suffered damages to its business as a result of its website and services being copied and utilized by the defendants. The plaintiff holds Social Mail LLC and Ankesh Kumar responsible because the defendants allegedly used plaintiff's trademark in trying to advertise their own business called emailmenot.com.
The plaintiff seeks an injunction, damages, statutory damages in the amount of $150,000 per infringement, all legal fees and any other relief as this court deems just. It is represented by Paul W. Reidl of the Law Office of Paul W. Reidl in Half Moon Bay.
