Flywheel Software accused of breaching contract regarding taxis

SAN FRANCISCO – A New York company alleges that a Redwood City mobile application developer tried to appropriate its customers after signing a contract.

Creative Mobile Technologies LLC filed a complaint on May 11 in the U.S. District Court for the Northern District of California against Flywheel Software Inc. alleging breach of contract, unfair competition and other counts.

According to the complaint, the plaintiff alleges that on Dec. 4, 2014, it entered into an agreement with the defendant regarding third-party taxicab fleets, and as a result of this agreement being breached, it suffered damages to its business. The plaintiff holds Flywheel Software Inc. responsible because the defendant allegedly prompted taxi fleets to divert electronic payments to them through their "e-hail" application instead of directing them to plaintiff.

The plaintiff requests a trial by jury and seeks injunction against the defendant from contracting with taxi partners to provide credit card processing services, damages adequate to compensate plaintiff plus interest, punitive and exemplary damages, all legal fees and any other relief as the court deems just.
