Time Warner seeks non-infringement declaration from court

SAN FRANCISCO – A cable company is seeking declaratory judgment from the court over accusations of patent infringement.

Time Warner Cable Inc. filed a complaint on May 4 in the U.S. District Court for the Northern District of California against OpenTV Inc., Nagravision SA and Kudelski SA.

According to the complaint, the plaintiff alleges that the defendants have accused it of infringing nine patents regarding television services. The suit states OpenTV Inc., Nagravision SA and Kudelski SA accuse the plaintiff of patent infringement for its use of services and equipment that are allegedly similar to the defendants' patents.

The plaintiff requests a trial by jury and seeks declaration that it did not infringe any patents mentioned in this case, injunction be issued to enjoin the defendants from threatening or initiating litigation against the it, all legal fees and any other relief as the court deems just. It is represented by David S. Bloch, Michael Brody, Krishnan Padmanabhan and Joshua L. Collins of Winston & Strawn LLP in San Francisco, Menlo Park, New York and Houston.
