Santa Clara Valley Transportation Authority accused of not paying overtime

SAN JOSE – A bus operator has filed a complaint against a public transportation service alleging that he was not properly compensated for all hours worked.

Robert Estorga filed a complaint on behalf of all other persons similarly situated on May 17 in the U.S. District Court for the Northern District of California, San Jose Division against Santa Clara Valley Transportation Authority citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per work week but was not paid any overtime wages. The plaintiff holds Santa Clara Valley Transportation Authority responsible because the defendant allegedly failed to pay their employees overtime compensation at time-and-one-half for all hours worked over 40 in a work week.

The plaintiff requests a trial by jury and seeks compensation for all amounts due and owing, liquidated damages equal to the back pay due and owing, all legal fees and any other relief as this court deems just. He is represented by William J. Flynn, Benjamin K. Lunch and Wan Yan Ling of Neyhart, Anderson, Flynn and Grosboll in San Francisco.
