Insurance 02

SAN FRANCISCO – A Contra Costa County woman alleges she is disabled and that disability benefits were wrongfully denied to her.

Anita Frias filed a complaint on May 19 in the U.S. District Court for the Northern District of California, San Francisco/Oakland Division against Metropolitan Life Insurance Co. and Sutter Health Long Term Disability Plan, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she suffers from complications from a head injury that happened in 2010. She claims that she applied for plan benefits in 2015 but was denied by the defendants. The plaintiff holds Metropolitan Life Insurance Co. and Sutter Health Long Term Disability Plan responsible because the defendants allegedly denied plaintiff's application for long-term disability plan benefits based on a doctor's findings that were determined without examining the plaintiff.

The plaintiff seeks order to pay plaintiff disability benefits, declare plaintiff has rights to receive future long-term disability benefit payments, all legal fees and any other relief as this court deems just. She is represented by Teresa S. Renaker, Margaret E. Hasselman and Kirsten G. Scott of Renaker Hasselman LLP in San Francisco.
