Ohio payday lenders facing class action over harassment allegations

SACRAMENTO – A Vallejo individual has filed a class-action lawsuit against an Ohio payday lender alleging it made harassing phone calls.

Patrick Roberts filed a complaint on behalf of all others similarly situated on May 20 in the U.S. District Court for the Eastern District of California against Buckeye Lending Solutions LLC, doing business as Checksmart, and Community Choice Financial Inc. alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in February, he was contacted on his mobile phone by the defendants using an artificial or pre-recorded voice. The plaintiff holds Buckeye Lending Solutions LLC and Community Choice Financial Inc. responsible because the defendants allegedly contacted plaintiff without prior consent.

The plaintiff requests a trial by jury and seeks injunctive relief, $1,500 for each violation as treble damages, $500 in statutory damages, all legal fees and any other relief as this court deems just.
