Liberty Life Insurance Co. accused of wrongfully terminating benefits

SAN FRANCISCO – An Oakland woman alleges her long-term disability benefits were wrongfully terminated.

J.L. filed a complaint on May 20 in the U.S. District Court for the Northern District of California against Liberty Life Insurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she suffers from alcohol dependence, major depressive disorder and generalized anxiety disorder and has been unable to work. The suit states she filed for disability benefits in October 2014, was paid benefits through September 2015, but was then denied by the defendant, as the defendant claimed she was not disabled under the terms of the plan. The plaintiff holds Liberty Life Insurance Co. of Boston responsible because the defendant allegedly denied plaintiff of her insurance benefits based on the report of its physician, who she alleges is biased

The plaintiff seeks order for the defendant to pay her long-term disability benefits plus interest, declare that plaintiff should receive future long-term disability benefits, all legal fees and any other relief as the court deems just.
