Novato residents accused of breaching loan contract

SAN FRANCISCO – Two Novato residents are being sued by an Arizona couple who alleges they are owed for an unpaid loan.

Donald Nix and Joan Nix filed a complaint on May 20 in the U.S. District Court for the Northern District of California against Andrew Chaban; Jodi Chaban; Healthworks Total Fitness Inc. doing business as Cole Valley Fitness; and Does 1 through 10, citing breach of contract.

According to the complaint, the plaintiffs allege that, since December 2015, they suffered monetary damages as a result of unpaid debt of a loan owed by the defendants. The plaintiffs hold the defendants responsible because the defendants allegedly failed to continue with the monthly payments for the loan and refuses to provide the collateral they agreed to in the contract, and that the defendants allegedly owe other miscellaneous loans.

The plaintiffs request a trial by jury and seek all damages, interest, enjoining and restraining the defendant from encumbering the collateral, all legal fees and any other relief as the court deems just. They are represented by Aaron R. Jackson of Jackson Law Group PC in San Francisco.
