Berkley Assurance Co. seeks rescission of insurance policy

SAN FRANCISCO – An insurance firm seeks the rescission of a policy over allegations the application contained misrepresentations.

Berkley Assurance Co. filed a complaint on May 26 in the U.S. District Court for the Northern District of California against CSV Hospitality Management LLC, 445 O'Farrell Street LLC, Suresh Patel, Sailesh Dvedhara and Does 1 through 50 alleging that they presented misrepresentations to their claim.

According to the complaint, the plaintiff alleges that in November 2014, it suffered damages as a result of misrepresentations presented to them at the time of application by the defendants. The plaintiff holds CSV Hospitality Management LLC, 445 O'Farrell Street LLC, Suresh Patel, Sailesh Dvedhara and Does 1 through 50 responsible because the defendants allegedly failed to provide full and accurate information to plaintiff to evaluate their application and whether to issue the policy.

The plaintiff requests a trial by jury and seeks rescind the policy, reimbursement, all damages according to proof, all legal fees and any other relief as this court deems just. It is represented by Maria S. Quintero and Travis Wall of Hinshaw & Culbertson LLP in San Francisco.
