SAN FRANCISCO – A California business alleges that a New Mexico corporation infringes its trademark.
Total Property Solutions Inc. filed a complaint on May 31 in the U.S. District Court for the Northern District of California against Total Property Solutions LTD citing trademark infringement and unfair competition.
According to the complaint, the plaintiff alleges that it has been in business since 2005 and registered its trademark in 2010. The plaintiff holds Total Property Solutions LTD responsible because the defendant allegedly used trademarks similar to it several years later and offers identical services to what the plaintiff offers, which causes confusion to its customers.
The plaintiff requests a trial by jury and seeks to permanently enjoin the defendant, all damages according to proof, recall from the defendant all materials that infringes plaintiff's trademark, all legal fees and any other relief as the court deems just.
