Netsuite Inc. accused of misrepresenting software

SAN FRANCISCO – A Canada corporation alleges a San Mateo company misled them about their business software.

Grouse River Outfitters LTD filed a complaint on June 2 in the U.S. District Court for the Northern District of California against Netsuite Inc. alleging fraudulent misrepresentation, breach of contract and other counts.

According to the complaint, the plaintiff alleges that between 2013 and 2016, it sustained damages, costs and loss of opportunities to its business because of its contract with the defendant. The plaintiff holds Netsuite Inc. responsible because the defendant allegedly made false representations to plaintiff about the reliability and functionality of its business software.

The plaintiff requests a trial by jury and seeks rescind the contract, compensatory damages of more than $75,000, award of three times its actual damages, punitive damages, interest, all legal fees and any other relief as this court deems just. They are represented by Loren Kieve of Kieve Law Offices in San Francisco.
