SAN FRANCISCO – A widow alleges that a prescription drug caused her husband's death.
Leatrice Oliver, individually and as executrix of the estate of Melvin Oliver, filed a complaint on June 2 in the U.S. District Court for the Northern District of California against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Johnson & Johnson Co., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, et al. citing strict liability, manufacturing defect, failure to warn, negligence and other counts.
According to the complaint, Melvin Oliver took Xarelto from May 2013 to June 2014. The plaintiff alleges that, between June 1, 2014, and June 3, 2014, Melvin Oliver suffered an intracranial hemorrhage that caused his death, which the plaintiff alleges was the result of taking Xarelto. The plaintiff holds the defendants responsible because the defendants allegedly failed to provide proper precaution to Melvin Oliver and his physicians about the potential harmful side effects of ingesting Xarelto.
The plaintiff requests a trial by jury and seeks special damages, financial support, punitive and exemplary damages, interest, all legal fees and any other relief as this court deems just.
