SACRAMENTO – A Canyon Lake corporation alleges a company is selling types of boats that infringe a patent it owns.
Mike Murphy's Enterprises Inc. filed a complaint on June 6 in the U.S. District Court for the Eastern District of California against Fineline Industries LLC and Does 1-100 alleging patent infringement.
According to the complaint, the plaintiff alleges that it suffered damages as a result of its '099 patent being infringed, which deals with ways to control boat wake. The plaintiff holds Fineline Industries LLC and Does 1-100 responsible because the defendants allegedly sell boats that use a system that infringes the '099 patent without acquiring any license or paying royalties to plaintiff.
The plaintiff requests a trial by jury and seeks permanently enjoin the defendant, award all damages to plaintiff, interest, all legal fees and any other relief as the court deems just. It is represented by Alan Heimlich of Heimlich Law PC in San Jose and Nick Heimlich of Law Offices of Nicholas D. Heimlich in San Jose.
