OAKLAND – An Arizona company alleges a labor group threatened its primary contractor to cease doing business with it on a project in Albany.
Electrical Prefab Systems LLC filed a complaint on June 8 in the U.S. District Court for the Northern District of California, Oakland Division against International Brotherhood of Electrical Workers, Local 595 alleging violation of the Labor Management Relations Act.
According to the complaint, the plaintiff alleges that in April it sustained damages to its business as a result of its contractor pulling out of their contract. The plaintiff holds International Brotherhood of Electrical Workers, Local 595 responsible because the defendant allegedly threatened CSI Electrical Contractors, plaintiff's contractor, to cease and refuse any existing and future dealings with plaintiff, causing CSI to cancel its contract with the plaintiff.
The plaintiff seeks actual, compensatory and consequential damages plus any exemplary, punitive, liquidated damages, all legal fees and any other relief as this court deems just. It is represented by Angela N. O’Rourke of Squire Patton Boggs (US) LLP in San Francisco and Daniel B. Pasternak of Squire Patton Boggs (US) LLP in Phoenix.
