Nevada man alleges undiagnosed knee infection resulted in second surgery

OAKLAND – A Nevada man has filed suit against a doctor and a medical center over allegations of failing to diagnose an infection after a knee surgery.

William D. McCann filed a complaint on June 13 in the U.S. District Court for the Northern District of California, Oakland Division against Dr. David Jupina, Tri Valley Orthopedics & Sports Medicine Group Inc., Does 1 through 10, and Black and White Corp. Does 1 through 10, alleging medical malpractice.

According to the complaint, the plaintiff alleges that he suffered pain from October 2014 to December 2015 due to a bacterial infection of his knee after he had surgery. The plaintiff holds the defendants responsible because the defendants allegedly failed to properly evaluate plaintiff's condition as well as provide him any post-surgery care. He alleges that the prosthesis in his right knee had to be replaced because of the infection.

The plaintiff requests a trial by jury and seeks compensatory damages, double damages, all medical expenses, punitive damages, and all legal fees. He is representing himself.
