Suit: Theranos falsely advertised accuracy of blood tests

SAN FRANCISCO – An Arizona man claims a Palo Alto company falsely advertised the accuracy of its blood tests.

Brian Maltese filed a complaint on behalf of all others similarly situated on June 17 in the U.S. District Court for the Northern District of California against Theranos Inc. alleging unjust enrichment, violation of state consumer laws and other counts.

According to the complaint, the plaintiff alleges that he suffered damages and may have placed his health at risk as a result of inaccurate blood test from the defendant. The plaintiff holds Theranos Inc. responsible because the defendant allegedly claims that its blood testing kits offer 100 percent accurate results but was later determined that it does not, which could purportedly cause serious health risks to consumers that rely on its product to check their blood.

The plaintiff requests a trial by jury and seeks enjoin the defendant, cost, restitution, all damages, disgorgement, interest, all legal fees and any other relief as the court deems just.
