Three Brothers Electrical Contractors Inc. accused of not allowing audit

SAN FRANCISCO – The boards of trustees for several labor union funds allege an employer breached its contract.

The board of trustees, in their capacities as trustees of the Laborers Health and Welfare Trust Fund for Northern California, Laborers Vacation-Holiday Trust Fund for Northern California; Laborers Pension Trust Fund for Northern California; and Laborers Training and Retraining Trust Fund for Northern California filed a complaint on June 27 in the U.S. District Court for the Northern District of California against Three Brothers Electrical Contractors Inc. alleging breach of contract.

According to the complaint, the plaintiffs allege that they cannot determine if the defendant has made payment of all fund contributions and has requested that the defendant submit to an audit. The plaintiffs hold Three Brothers Electrical Contractors Inc. responsible because the defendant allegedly refused to allow an audit of their records and reports by the plaintiffs.

The plaintiffs seek order to submit to a full audit, actual damages, pay due sums to plaintiff upon completion of the audit plus interest, enjoin the defendant, all legal fees and any other relief as the court deems just.
