City of Benicia accused of not paying overtime wages

SACRAMENTO – A class-action suit has been filed against a California city over allegations it did not pay its employees overtime wages.

Jason Fein filed a complaint on behalf of all others similarly situated on July 27 in the U.S. District Court for the Eastern District of California against the city of Benicia alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per workweek but was not paid any overtime wages. The plaintiff holds city of Benicia responsible because the defendant allegedly failed to pay plaintiff overtime compensation for all his hours worked in excess of 40 hours per workweek.

The plaintiff seeks all unpaid overtime compensation and interest, liquidated damages equal to the unpaid overtime wages, all legal fees and any other relief as the court deems just. He is represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
