Insurance company seeks to rescind policy for Sullivan Vineyards

SAN FRANCISCO – A Georgia-based insurance firm alleges a Rutherford winery misrepresented information on an application for insurance.

Maxum Indemnity Co. filed a complaint on June 27 in the U.S. District Court for the Northern District of California against Sullivan Vineyards Corp., Kelleen Sullivan and Ross Sullivan seeking declaratory judgment and rescission.

According to the complaint, the plaintiff alleges that it suffered damages as a result of issuing a policy under wrong information given to it by the defendants. The plaintiff holds Sullivan Vineyards Corp., Kelleen Sullivan and Ross Sullivan responsible because the defendants allegedly misrepresented the material information they gave plaintiff in order for them to issue the policy.

The plaintiff seeks rescission of the policy and declaration that the policy is void, declare that plaintiff has no duty to defend or indemnify the defendant, all legal fees and any other relief as this court deems just.
