SACRAMENTO – A former warehouse supervisor alleges his benefits have been wrongfully terminated.

Joey Adney filed a complaint on July 7 in the U.S. District Court for the Eastern District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in May 2012, he became disabled according to the terms of the plan. The suit states he was initially receiving disability benefits until his claim for ongoing benefits was denied by the defendant on Jan. 6, 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's claim for ongoing disability benefits despite his several appeals and despite of having sufficient medical records to support his disability claim.

The plaintiff seeks award benefits due to him including interest, order that he is entitled to future disability benefits as long as he remains disabled according to the terms of the plan, all legal fees and any other relief as the court deems just.
