Medical malpractice 01

SAN FRANCISCO – A Texas woman has filed suit against a Contra Costa County man alleging he punched her in the face after a discussion near the Campus Corner district in Norman, Oklahoma.

Amelia Molitor filed a complaint on July 22 in the U.S. District Court for the Northern District of California against Joe Mixon alleging negligence, willful and wanton misconduct and other counts.

According to the complaint, the plaintiff alleges that on July 25, 2014, she was out with friends at Pickleman's Gourmet Cafe in Norman, where she got into a discussion with Mixon that became heated. The suit states Molitor pushed the defendant away to end the discussion. The plaintiff holds Mixon responsible because the defendant allegedly struck plaintiff with a closed fist in response, which fractured bones in her face and caused other injuries.

The plaintiff requests a trial by jury and seeks economic losses and noneconomic losses, punitive damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Robert H. Bohn Jr. of Bohn & Fletcher LLP in San Jose; Ben Baker of Purcell, Oklahoma; and Rusty Smith of Brennan, Smith & Sherbini PLCC in Muskogee, Oklahoma.
