LOS ANGELES – A limited liability company alleges it was deceived into signing a lease for a store in a Washington mall because of the financial documents provided by a Los Angeles firm.
Bellevue Square LLC filed a complaint on Aug. 3 in the U.S. District Court for the Central District of California, Western Division against Nigro Karlin Segal Feldstein & Bolno LLC alleging negligent misrepresentation and other counts.
According to the complaint, the plaintiff alleges that in May 2014, Bellevue Square LLC was approached by Windsor Financial Group as prospective lessee to one of its properties, Bellevue Square Shopping Center, to open an ASICs store. It alleges that it requested Windsor's financial statement before it would sign a lease, and it received the statements as prepared by the defendant.
The plaintiff holds Nigro Karlin Segal Feldstein & Bolno LLC responsible because the defendant allegedly supplied false and misleading information, induced the plaintiff by releasing financial statements that would enticed it to enter into a business transaction with Windsor, and maliciously misrepresented a company where it has pecuniary interest. Bellevue Square LLC claims it was ignorant of the alleged falsity of these financial statements and entered into a written lease with Windsor NY for a period of 121 calendar months, causing it to suffer from monetary loss due to Windsor's alleged non-payment of rent and purported failure to undertake improvement to leased premises.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount to be proven at trial, attorney's fees and costs and such other relief the court deems just. It is represented by Mark C. Lamb and David A. Nold of Nold Muchinsky PLLC in Bellevue, Washington.
