LOS ANGELES — A fabric manufacturer has filed a claim against The TJX Cos. Inc. and Does 1-10, alleging that the defendants copied a particular textile print.
Standard Fabrics International Inc. filed a complaint on Aug. 1 in the U.S. District Court for the Central District of California against the defendants, also doing business as T.J. Maxx, alleging that they have committed copyright infringement with actual or constructive knowledge of the plaintiff’s rights.
According to the complaint, the plaintiff alleges that it was informed that the defendants had copied a particular textile print that was tagged as design number 8360. The plaintiff claims the defendants had access to it through its showroom, design library and garments sold to its customers.
The plaintiff holds The TJX Cos. Inc. and Does 1-10 responsible because the defendants allegedly distributed, reproduced and sold copies of design 8360 in blatant disregard for the plaintiff's rights. The plaintiff claims to have suffered general and substantial damages to its business.
The plaintiff requests a trial by jury and seeks revenues derived from the defendants' sales, damages sustained to be determined at the time of trial, statutory damages, attorneys' fees, interest and costs of this action and further legal and equitable relief as the court deems suitable, as well as the sum of up to $150,000 per infringement.
