SAN DIEGO – A San Diego County resident alleges he was sent a letter from a debt collector for an amount he did not owe.
Hemin Miran filed a complaint on Aug. 16 in the U.S. District Court for the Southern District of California against Ad Astra Recovery Services Inc. alleging that the collecting agent violated the Fair Debt Collection Practices Act and the Rosenthal Fair Debt Collections Practices Act.
According to the complaint, the plaintiff alleges that sometime after Aug. 18, 2015, he received a collection notice from the defendant that stated the plaintiff owed $31,500 to Payday Advance Loan with Speedy Cash. The suit states the plaintiff did not owe and never owed such amount. The plaintiff holds Ad Astra Recovery Services Inc. responsible because the defendant allegedly caused stress, anxiety and expenses.
The plaintiff requests a trial by jury and seeks actual and statutory damages, interest, attorney's fees, costs of suit and other relief as the court may deem proper. He is represented by Alex Asil Mashiri of Mashiri Law Firm in San Diego.
