SAN DIEGO – A seaman employed by the federal government alleges that he was injured aboard a drone landing ship.

Dustin B. Daniels filed a complaint on Aug. 16 in the U.S. District Court for the Southern District of California against United States of America alleging unseaworthiness and negligence.

According to the complaint, the plaintiff alleges that in Aug. 19, 2014, while he was serving aboard the ATLS-9701, operating off the coast of San Diego County and owned by the defendant, he sustained serious injury to his left leg and was required to undergo extensive medical treatment, was declared not-fit-for duty for a period of time and incurred charges for medical care. The plaintiff holds United States of America responsible because the defendant allegedly failed to provide plaintiff with a safe place to work, failed to make prompt and/or full payment of all medical maintenance and cure due and failed to furnish plaintiff with proper and sufficient supervision.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages of more than $75,000, maintenance and cure, interest, costs of suit and further relief as is proper and just. He is represented by Edward M. Bull III and Kurt Micklow of Brodsky Micklow Bull & Weiss LLP in Alameda.
