Burlington Stores allegedly used a copyrighted design on apparel

LOS ANGELES — A garment manufacturer has filed suit against retailers for alleged copyright infringement.

Neman Brothers & Associates Inc. filed a complaint on Aug. 4 in U.S. District Court for the Central District of California against Burlington Stores Inc., One Step Up Ltd. and Does 1-10, alleging that they violated the plaintiff’s intellectual property rights.

According to the complaint, the plaintiff alleges that it created, purchased and obtained graphic artwork for use on textiles and garments. One piece was a copyrighted design tagged as NB121214X-R that the defendants purportedly replicated without consent, thereby causing the plaintiff's business to suffer damages. 

The plaintiff holds Burlington Stores Inc., One Step Up Ltd. and Does 1-10 responsible because the defendants allegedly gained profit from the illegal reproduction of the infringed design and committed acts of infringement with actual knowledge of the plaintiff's rights.

The plaintiff requests a trial by jury and seeks that the defendants be enjoined from infringing upon the plaintiff’s copyrights, attorneys' fees, interest, costs of suit and other relief as the court deems appropriate.
