Athletic Xtreme claims competitor's alleged false advertising is harmful to marketplace

LOS ANGELES – A manufacturer of sports supplements alleges a competitor falsely advertises its products as healthy and safe.

Nutrition Distribution LLC, doing business as Athletic Xtreme, filed a complaint on Aug. 1 in the U.S. District Court for the Southern District of California against Chaos and Pain LLC and Does 1-10 alleging false advertising.

According to the complaint, the plaintiff is a sports supplement manufacturer and marketer. The plaintiff alleges that the defendant marketed its selective androgen receptor modulators (SARMs) products as dietary supplements, promising numerous benefits without any of the negative side effects of steroids. However, the suit states SARMs products are not safe for human consumption. The plaintiff claims the defendant's allegedly false advertising gives the targeted market, bodybuilders, little incentive to try the plaintiff's reportedly natural product.

The plaintiff holds Chaos and Pain LLC and Does 1-10 responsible because the defendants allegedly created an illegitimate marketplace to those who were not fully informed of the dangers of SARMs and introduced its false and misleading statements into interstate commerce.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, attorneys' fees and other relief the court may deem just. It is represented by Robert Tauler, Matthew J. Smith and Tauler Smith LLP of Tauler Smith LLP in Los Angeles.
