A brand ambassador is suing proprietor for alleged breach of contractThe Kayo Corp. allegedly failed to uphold its contract with a brand ambassador

SAN DIEGO — A brand ambassador has filed suit against an athletic men's apparel and accessories company for allegedly breaching their contract. 

Rick Ross Touring LLC filed a complaint  Aug. 26 in U.S. District Court for the Southern District of California against The Kayo Corp., alleging that the proprietor failed to pay the amount due for services rendered per their agreement.

According to the complaint, the plaintiff alleges that on July 10, 2014, Rick Ross Touring LLC, a company wholly owned by William L. Roberts II who is more commonly known as “Rick Ross," entered an agreement with the defendant to serve as a brand ambassador to its clothing line. The agreement stated that the plaintiff would be paid an ambassador fee equal to one percent of the gross sales of all products sold, a guaranteed minimum payment of $10,000 per month and seven percent of profit interest. The defendant allegedly was only able to pay the monthly minimum of $10,000 from July 2014 until November 2015. The plaintiff holds The Kayo Corp. responsible because the defendant allegedly failed or refused to pay the full amount due to the plaintiff as required under the agreement, failed to propose a resolution to address the amount owed and refused to provide an account to determine profit interest.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages at a minimum of $80,000, attorneys' fees, interest, costs of suit and further relief as the court may deem just.
