Engineering company claims Nextek Power Systems allegedly hasn't paid for design services

SAN DIEGO — An engineering company has filed suit against a Nevada corporation, alleging the business violated an agreement by refusing to pay for contracted services.

Rhombus Energy Solutions Inc. filed a complaint on Aug. 1 in U.S. District Court for the Southern District of California against Nextek Power Systems Inc., alleging that the defendant has a remainder of $141,00 owed to the plaintiff.

According to the complaint, the plaintiff alleges that in 2014, Rhombus Energy Solutions Inc. entered an agreement to design and build a product specified by the defendant and the plaintiff was to be paid in return for all incurred expenses and hours worked by its employees. To date, the plaintiff's invoices have only been initially paid, the plaintiff alleges.

The plaintiff holds Nextek Power Systems Inc. responsible because the defendant allegedly failed to honor an agreement and refused to perform its obligation to pay.

The plaintiff requests a trial by jury and seeks judgment against the defendant, payment for work performed, damages, interest and costs of suit. It is represented by Richard E. McCarthy of Solomon Ward Seidenwurm & Smith LLP in San Diego.
