LOS ANGELES – A Las Vegas boxing promoter alleges two sports media and marketing companies over allegations they entered into third-party contracts without authorization.
GoBox Promotions Inc. filed a complaint on Sept. 6 in the U.S. District Court for the Central District of California against Innovative Sports Management Inc., Protocol Sports Marketing LTD, Doug Jacobs and Does 1-1 alleging copyright infringement, unjust enrichment and other counts.
According to the complaint, the plaintiff alleges that it executed an agreement with defendants to market and distribute a boxing event with the stipulation that the defendants were to obtain permission from the plaintiff before they entered into any third-party agreements regarding exhibitions of the event.
The plaintiff alleges that the defendants entered into several third-party agreements regarding live and tape delay exhibitions of the copyrighted event without consent from plaintiff in 2015.
The plaintiff holds Innovative Sports Management Inc., Protocol Sports Marketing LTD, Doug Jacobs and Does 1-10 responsible because the defendants allegedly failed to provide plaintiff with a sales report for foreign territories, failed to inform plaintiff of international sales, failed to acquire written approval from plaintiff for international license agreements and failed to bill plaintiff a 20 percent commission for international sales.
The plaintiff requests a trial by jury and seeks judgment in its favor, damages for copyright infringement of $105,300 and $7,000 euros; damages for breach of contract of $105,300 and $7,000 euros; statutory damages of $2,100,000; punitive damages; interest; attorney's fees; costs of suit and other relief as the court deems appropriate.
