LOS ANGELES — A California-based textile company has filed suit against retailers for alleged copyright infringement.
Unicolors Inc. filed a complaint Sept. 13 in U.S. District Court for the Central District of California against Ross Stores Inc., Rainbow USA Inc., Beall's Inc. and Does 1-10, alleging that they violated the copyright laws by selling infringing products.
According to the complaint, the plaintiff alleges that Unicolors Inc. was made aware that its copyrighted design of a two-dimensional artwork entitled EH 101 was purchased, sold, marketed and manufactured by the defendants without permission, which features a design that was allegedly identical to that owned by the plaintiff, which caused it to suffer substantial damages to its business and goodwill.
The plaintiff holds Ross Stores Inc., Rainbow USA Inc., Beall's Inc. and Does 1-10 responsible because the defendants allegedly violated the plaintiff’s intellectual property rights and obtained profits for their infringement of the subject design.
The plaintiff requests a trial by jury and seeks judgment in its favor, to enjoin the defendants from further infringement, be awarded profits, attorneys' fees, interest, costs of litigation and further relief as the court deems proper.
