LOS ANGELES – A Vallejo company is accused of not paying contributions on behalf of its employees to various labor union funds.
Board of trustees of the Inland Empire IBEW-NECA Defined Contribution Trust Fund; board of trustees of the Inland Empire IBEW-NECA Health Plan, board of trustees of the Riverside County Electrical Educational and Training Trust Fund; et al. filed a complaint on Sept. 12 in the U.S. District Court for the Central District of California against Steiny and Co. Inc. alleging violation of the Employee Retirement Income Security Act and breach of written collective bargaining agreements.
According to the complaint, the plaintiffs allege that they suffered damages from the unpaid and late paid benefit contributions in the amount of $15,416.95 for fringe benefits and $2,496.63 for union dues. The plaintiffs hold Steiny and Co. Inc. responsible because the defendant allegedly breached its bargaining agreement by failing to pay its monthly contributions on behalf of its employees.
The plaintiffs seek unpaid fringe benefit contributions, liquidated damages, damages, interest, all legal fees and any other relief as the court deems just. They are represented by Kerry K. Fennelly and Valentina S. Mindirgasova of Cornwell & Baldwin in Escondido.
