Owner of Dazed and Confused shop accused of selling counterfeit RooR products

LOS ANGELES – A Corona corporation alleges that a retail smoke shop in Hesperia is selling counterfeit products.

Sream Inc. filed a complaint on Sept. 19 in the U.S. District Court for the Central District of California against Bonnie Bova and Does 1-10 alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it has been the exclusive licensee of the RooR mark, a German brand known for its smoker's water pipes and parts, and has the rights to market, sell and distribute RooR products. It alleges the defendant, who operates as Dazed and Confused, is selling counterfeit RooR products.

The plaintiff holds Bova and Does 1-10 responsible because the defendant allegedly gained profit at the expense of plaintiff, tarnished plaintiff's reputation by affixing the RooR mark to inferior products and introduced counterfeit products into the stream of commerce.

The plaintiff requests a trial by jury and seeks judgment in its favor, profits and statutory damages of up to $2,000,000 per defendants, attorney's fees, costs of suit, joint liability for officers and directors of the defendants, restitution, injunctive relief, disgorgement, constructive trust and further relief as the court may deem just.
