LOS ANGELES – Several residential care facilities are alleged to have misclassified their employees as independent contractors and did not properly compensate them.
Secretary of Labor Thomas E. Perez filed a complaint on Oct. 6 in the U.S. District Court for the Central District of California against Alternative Senior Care Inc., La Bella Holdings LLC, RG Holdings LLC, Advocate Care Placement LLC, Tonya Campo, Geneane Paschal, Maria Emeterio and Jeremy Parungao citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges the defendants did not fairly compensate their employees for their work. The plaintiff holds Alternative Senior Care Inc., La Bella Holdings LLC, RG Holdings LLC, Advocate Care Placement LLC, Campo, Paschal, Emeterio and Parungao responsible because the defendants allegedly failed to pay their employees overtime wages, failed to keep employees' time records, took illegal deductions for the employers' share of Social Security contributions and other counts.
The plaintiff seeks enjoin the defendants, hold the defendants liable for any unpaid minimum and overtime compensation that may be due, liquidated damages, and any other relief as the court deems just. He is represented by Grace A. Kim of United States Department of Labor in Los Angeles.
