Salinas Tires & Wheels alleges competitor is using trademark

Trademark 01

LOS ANGELES – A La Habra business alleges a former employee started a competing company and is using its trademark.

Grupo Salinas Inc., doing business as Salinas Tires & Wheels, filed a complaint on Oct. 20 in the U.S. District Court for the Central District of California against J R Salinas Wheels & Tires Inc., JJTS Inc. and Salinas Wheels & Tires alleging trademark infringement and unfair competition.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its Salinas trademark being used by a competitor, which was started by a former employee. The plaintiff holds J R Salinas Wheels & Tires Inc., JJTS Inc. and Salinas Wheels & Tires responsible because the defendants allegedly used plaintiff's Salinas mark without its permission.

The plaintiff requests a trial by jury and seeks permanent injunction against the defendants, monetary award for corrective advertising, disgorgement, all damages, treble damages, all legal fees and any other relief as the court deems just. It is represented by Thomas J. Daly and Drew Wilson of Lewis Roca Rothgerber Christie LLP in Glendale.
