SAN FRANCISCO – An employer is accused of not submitting to an audit or paying a withdrawal liability per a bargaining agreement between it and a labor union.
The board of trustees in their capacities as trustees of the CMTA-Glass Molders, Pottery, Plastics & Allied Workers Local 164B Pension Trust and the CMTA-Glass, Molders, Pottery Plastics & Allied Workers Local 164B Health and Welfare Trust filed a complaint on Oct. 31 in the U.S. District Court for the Northern District of California against Valley Pattern & MFG Inc. alleging breach of contract and other counts.
According to the complaint, the plaintiffs allege that the defendant refused to submit to an audit to determine the amount of fringe benefits owed. They also allege that the defendant withdrew from participating in the pension trust in May 2015 and has not paid the liability.
The plaintiffs seek submit to a full audit, actual damages, order for the defendant to pay over sums after the audit plus interest, play withdrawal liability of $178,311 plus interest, all legal fees and any other relief this court deems just.
