LOS ANGELES – An Idaho-based weight loss product company alleges a Massachusetts couple copied its website.
Trust Safe Pay LLC filed a complaint on Oct. 24 in the U.S. District Court for the Central District of California against the Dynamic Diet LLC, Kostas Vadoklis, Vilma Vadoklis and Does 1-10 alleging copyright infringement, misappropriation of trade secrets, fraud and other counts.
According to the complaint, the plaintiff's principal, Evelina Jachneviciute, and her husband began a weight loss products business in 2009. In 2012, the suit states Jachneviciute asked Vilma Vadoklis to fulfill orders for their business while they were on vacation, during which the defendant allegedly had access to the plaintiff's business information.
The plaintiff holds Dynamic Diet LLC, Kostas Vadoklis, Vilma Vadklis and Does 1-10 responsible because the defendants allegedly launched copycat websites of the plaintiff's website to misappropriate its customer base.
The plaintiff requests a trial by jury and seeks actual damages not less than $1.6 million plus interest, general and consequential damages not less than $1.6 million, exemplary and punitive damages, all legal fees plus interest and any other relief as the court deems just.
