Nu Image Inc. accused of not paying residual contributions

LOS ANGELES – Labor union trusts allege that a California employer did not make residual contributions to them.

Directors of the Motion Picture Industry Pension Plan and Directors of the Motion Picture Industry Health Plan filed a complaint on Oct. 31 in the U.S. District Court for the Central District of California against Nu Image Inc. citing the Employee Retirement Income Security Act and the Labor Management Relations Act.

According to the complaint, the plaintiffs allege that the defendant received payments from territorial distributors for several films and that per the agreement signed between the parties, the defendant must make payments to order to make residual contributions. The plaintiffs allege that the defendant has not made payments.

The plaintiffs seek unpaid contributions and liquidated damages in an amount to be determined at trial, interest, all legal fees and any other relief as the court deems just. They are represented by Peter S. Dickinson, David E. Ahdoot and Kirk M. Prestegard of Bush Gottlieb in Glendale.
