LOS ANGELES – A Los Angeles corporation alleges an online Washington-based retailer is selling clothes made of infringing fabric designs.
Gold Value International Textile, doing business as Fiesta Fabric, filed a complaint on Oct. 31 in the U.S. District Court for the Central District of California against Zulily LLC and Does 1 through 10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Zulily LLC and Does 1 through 10 responsible because the defendants allegedly used online websites and retail stores to sell garments comprised of fabrics that bear a similar design as plaintiff's fabrics.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, award plaintiff all profits of the defendant, statutory damages, all legal fees and interest plus any other relief as the court deems just.
