Advertisers accuse Facebook of unfair conduct over video advertisements

SAN FRANCISCO – Three Nevada residents allege a Menlo Park-based social media company misrepresented the statistics on its video advertising.

Tom Letizia, Mark Fierro and Greg Austin Jr. filed a complaint individually and on behalf of all those similarly situated on Oct. 27 in the U.S. District Court for the Northern District of California against Facebook Inc. and Does 1-20 alleging unfair conduct and other counts.

According to the complaint, the plaintiffs allege that they were enticed to purchase defendants' video advertisement to further gain profit for their commercial products or services. However, the suit states that the defendants admitted to having inflated the viewing statistics by 60 to 80 percent, which caused plaintiffs to suffer from monetary losses of having to pay for premium prices expecting to gain extra mileage for their businesses.

The plaintiffs hold Facebook Inc. and Does 1-20 responsible because the defendants allegedly misrepresented their advertising medium to induce advertisers to pay premium prices.

The plaintiffs request a trial by jury and seek judgment against defendants, damages, attorney’s fees, costs of court, certify case as a class action, designate class representative and counsel, interest and other relief as the court may deem just. They are represented by Robert T. Eglet, Robert M. Adams and Erica D. Entsminger of Eglet Prince in Las Vegas and Joseph A. Motta of Rueb & Motta in Concord.
