LOS ANGELES – An auto manufacturer alleges a Redondo Beach company is using its name to falsely advertise aftermarket auto parts and accessories.

FCA US LLC, formerly known as Chrysler Group LLC, filed a complaint on Oct. 27 in the U.S. District Court for the Central District of California, Western Division against Scat Enterprises Inc., Philip Thomas Lieb, Craig Schenasi and Does 1-5 alleging false designation of origin, false advertising and unfair competition.

According to the complaint, the plaintiff alleges that the defendants are using a prominent medallion that states Scat Enterprises is the official supplier of the car seat used in one of Chrysler's vehicles. The plaintiff states it has never given the defendants any consent to use or exploit its name or any of its trademarks in any of defendant's advertising or other publications, nor were the defendants contracted to supply seats for plaintiff.

The plaintiff holds Scat Enterprises Inc., Lieb, Schenasi and Does 1-5 responsible because the defendants allegedly misled and deceived the public to its true affiliation and origin, and obtained profits and advantages for its own purposes and benefit at the expense of plaintiff.

The plaintiff requests a trial by jury and seeks judgment in its favor, injunctive relief, damages, disgorge revenues and advantages from unlawful acts, attorneys' fees, costs, interest and further relief as the court may deem just. It is represented by Kent R. Raygor and Paul A. Bost of Sheppard Mullin Richter & Hampton LLP in Los Angeles.
