LOS ANGELES – A San Diego business is accused of selling garments with fabric designs used without permission.
Gold Value International Textile, doing business as Fiesta Fabric, filed a complaint on Nov. 1 in the U.S. District Court for the Central District of California against Charlotte Russe Inc. and Does 1 through 10 alleging copyright infringement.
According to the complaint the plaintiff alleges that it suffered damages to its business as the result of the infringement. The plaintiff holds Charlotte Russe Inc. and Does 1 through 10 responsible because the defendants allegedly sold garments that features fabrics that have similar designs as plaintiff's through online and retail stores.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's designs, award all profits to the plaintiff, statutory damages, all legal fees and interest plus any other relief as the court deems just.
