LOS ANGELES – A Los Angeles employer is accused of failing to make contributions on behalf of its employees per a bargaining agreement.
Graphic Arts Industry and GCIU 404 Health and Welfare Trust Fund filed a complaint on Nov. 3 in the U.S. District Court for the Central District of California, Western Division against Mitchell Publishing Inc. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that Graphic Arts Industry and GCIU 404 Health and Welfare Trust Fund suffered damages due to late paid and unpaid contributions. The plaintiff holds Mitchell Publishing Inc. responsible because the defendant allegedly breached its bargaining agreement with the labor group by failing to pay its monthly contribution on behalf of its employees.
The plaintiff seeks unpaid contributions, interest, liquidated damages, all legal fees and any other relief as this court deems just. It is represented by Howard Z. Rosen and Amanda Pitrof of Posner & Rosen LLP in Los Angeles.
