PIC Group Inc. alleges Buena Vista Biomass Power did not pay for services provided

SACRAMENTO – A service provider for power plants alleges it was not compensated for services offered at a plant near Ione.

PIC Group Inc. filed a complaint on Oct. 26 in the U.S. District Court for the Eastern District of California against Buena Vista Biomass Power LLC alleging breach of written agreement and other counts.

According to the complaint, the plaintiff alleges that on Aug. 14, 2012, PIC Group Inc. entered an agreement with the defendant where it was to provide standard operations and routine maintenance services at the defendant's power plant. On May 29, 2013, the suit states that the boiler at the plant exploded and two workers were injured and the plaintiff paid $100,000 for its workers' compensation claims. The suit states that it was later determined that the injured workers were under the supervision of the defendant at the time of the incident.

The plaintiff holds Buena Vista Biomass Power LLC responsible because the defendant allegedly refused to pay plaintiff the full amount it was owed for its services fully rendered, failed to fulfill its part of the agreement in good faith, failed to reimburse plaintiff for the $100,000 workers’ compensation claims or the $2,570.12 in attorney’s fees incurred.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages in the principal amount of $421,029.59 plus prejudgment interest, attorney’s fees, costs and expenses, and further relief as is necessary.
